Initiative 502- Legalization of Marijuana, what’s happening?

A lot of people are wondering, just as I am, with the implementation of the legalized recreational marijuana system passed by Washington voters with Initiative 502 what’s going to happen?  As a DUI attorney/ criminal attorney I’m especially interested in having a pulse on what’s going on.  As of January 18, 2013, the Washington State Liquor Control Board is now seeking proposals for marijuana consulting services in: product and industry knowledge, product quality standards and testing, product usage and consumption validation and product regulation.  This is good news.  It’s great to see progress and the State requesting consultants to assist in Initiative 502 implementation.  Times have definitely changed here in Washington.  What remains to be seen is will the change be considered a positive one for all of us.

As a Seattle attorney who represents those accused of Driving Under the Influence DUI/drunk driving cases I’m interested in how the State will prosecute such cases as it relates to marijuana consumption.  The real issue in Marijuana DUI cases is whether or not the driver’s ability to drive was affected by consuming marijuana.  Factors to consider of signs of intoxication would include but not limited to, active components of THC in a driver’s system, time of last consumption in relation to time of driving, and the driving observed.  Just as with alcohol consumption, marijuana consumption and it’s effects on individuals vary considerably.  As a result, I think marijuana DUI cases are tough to defend but even tougher to prosecute.

Defense Attorney Pleads No Contest for Joe Simpson’s DUI

November 2012, criminal defense attorney to the stars, Shawn Holley, formally entered Joe Simpson into a no contest plea for his DUI charge he received months prior in August.  Around 10 in the evening, Joe Simpson, father of singing scarletts Jessica Simpson and Ashley Simpson, was arrested on Ventura Boulevard in L.A. for DUI (driving under the influence).  Papa Simpson reported he drank  just a few glasses of wine during dinner with his wife, however, Joe’s DUI breathalyzer test revealed a .13 BAC which is well above  California’s legal limit of .08.  He was arrested, charged with DUI, and was taken to the slammer.

Did criminal defense attorney, Shawn Holley, who has represented many A-listers like Lindsey Lohan, fight for Joe Simpson’s rights and get the best case resolution for his DUI?  Entering a no contest plead is essentially pleading guilty, which stinks for Joe who paid big bucks for his DUI lawyer!   Most likely defense attorney Holley did her best.  With DUI cases criminal defense attorneys look for evidentiary issues, examine police reports and police protocol, and try to discover defenses.  Pleading no contest was most likely Joe’s best option, he was truly DUI.

Simpson was sentenced to three years of probation, a fine of $390 dollars, and ordered to complete a three-month DUI alcohol education program.  Hopefully, Grandpa Simpson has learned his lesson and will stay home and help watch grandkids.  Congrats to Jessica Simpson who just announced she is preggers with baby number 2!

Only 1 DUI for Scott Disick?

In all of Scott Disick’s 29 years of life, could it be true, only 1 DUI charge for the “Keeping Up with The Kardashians” reality TV star?  It seems so!  The daddy of Kourtney Kardashian’s 2 babies, is known for wild nights of clubbing, heavy drinking, and outrageous behavior.  However, when it comes to DUI, Scott doesn’t do it anymore!  His one and only DUI charge happened years ago when he was under the legal age to consume alcohol.

According to an article on wetpaint.com, a youthful 18-year-old, Scott Disick, crashed his car in Riverhead, NY, just miles away from his Eastport residence.  During the accident investigation, New York police officers reported they could smell alcohol on Scott’s breath and had him perform the DUI field sobriety tests.  Disick failed the DUI field tests and was taken to jail.  Later in court, Scott pled guilty to the DUI charge.

Perhaps Disick learned his DUI lesson early on in life and consciously chooses not to DUI.  Or perhaps, Scott’s paid designated driver, his chauffeur, taking him from one night club to the next and then home early the next morning has kept Scott DUI free.  What ever the reason may be, Scott Disick has obviously made good decisions about not driving drunk or DUI!
