Kanye West Pleads “No Contest” To Misdemeanor Assault Charge

Kanye West’s criminal defense attorney recently plead “no contest” to the assault charge filed against Kanye back in July of 2013 for attacking a photographer.  In return for pleading no contest, the LA City Attorney and judge decided to dismiss the attempted grand theft auto charge that had accompanied the assault charge, and allowed K.W. to enter into a deferred sentence.

For the deferred sentence of the assault charge, Kanye must complete two years of probation, meaning he must remain out of legal trouble for at least two years.  The “Yeezus” rap artist must also complete 24 private therapy sessions for anger management and 250 hours of community service.  Kanye was ordered to pay for all medical bills incurred by  photographer, Daniel Ramos, and he must pay for any photography equipment that was damaged during their altercation at the Los Angeles International Airport.

If 36 year-old Kanye fails to stay out of legal trouble or doesn’t comply with all of the judges orders, than Kanye will have revoked his deferred sentence.  When the deferred sentence is revoked the judge will impose a sentence, which would likely be jail time and additional fines for Kanye.

During the last court appearance, of which Kanye West was not present, Daniel Ramos and his defense attorney had an opportunity to address the court and judge.  Daniel spoke of the emotional and physical trauma he suffered during the scuffle and how it still haunts him.  He told the judge that Kanye should go to jail for the battery and that he felt the attack was an intentional ploy for Kanye to promote his new album “Yeezus” that released just one day before the incident.

Daniel Ramos is no stranger to quarreling with the stars, in 2007 Britney Spears lashed out and hit his car with her umbrella while he was taking photos.

Kanye and his defense attorney will have to reappear in court for a review hearing on July 17th to follow-up on his therapy sessions, community service hours, and will be given the specific restitution amount he will pay out to Daniel Ramos.

Defense Attorney Saves Lindsay Lohan Despite Being Fired

Lindsay Lohan must have been out of her mind for firing her long standing criminal defense attorney, Shawn Holley, on January 14th, just 1 day prior to her next court appearance! Known for unruly behavior and compulsive decision making, Lohan, hired a New York defense lawyer, Mark Heller, who is also defending her on the Manhattan night club assault case (see my earlier blog Assault by Lindsay Lohan) to replace attorney Shawn Holley.  Soon after the “Liz and Dic” actress signed Shawn Holley’s termination papers, she knew she made a mistake, freaked out and wanted Holley back on her case!

Lucky for Lindsay, super hero attorney Holley came to her rescue one last time to plead not guilty for her to three misdemeanor counts she racked up when she drove her Porche into a dump truck on the Santa Monica Highway.  According to NYDailyNews.com, Lohan’s misdemeanor charges include, willfully obstructing the accident probe, reckless driving, and lying to police officers.  Rumors have surfaced Holley showed up to court in spite of knowing she was kicked to the curb, to collect on her outstanding legal fees of $300,000, of which Lohan hadn’t paid for six months.

After finding a California attorney to sponsor him, lawyer Mark Heller, is now serving as Lindsay’s legal representation.  Their next court date has been scheduled for January 30th for a pretrial hearing.

If found guilty of the misdemeanor charges and probation violation, Lindsay could be facing some serious time in jail, which equates to only a week or two for an A-List celebrity.   I’ll keep you posted on more Lohan legal drama, it never ends!

Assault by Lindsay Lohan?

Lindsay, Lindsay, Lindsay, she just can’t stay away from legal trouble.  This time TMZ.com reported Lindsay Lohan allegedly punched a women in the left side of the face at Club Avenue, a New York nightclub.  Lindsay was arrested Nov. 29th at 4 in the morning and charged with 3rd degree misdemeanor assault.  Lohan is pissed about the situation and believes the victim, a women named Tiffany Mitchell, is fabricating the accusation to get her to write a check.

Tiffany Mitchell has already hired big time attorney Gloria Allred to sue Lohan for damages.  Attorney to the stars, Gloria Allred may have a tougher case than she anticipates, photos of Mitchell leaving the club have leaked and don’t show any bruising or damage to the left side of her face.  Also, a photo released today doesn’t indicate assault to the face, on the contrary, Mitchell’s facial skin looks flawless.  Not a smart move by attorney and victim to have photos taken displaying a picture perfect face.

Lohan has hired a private investigator to dive into Mitchell’s criminal history and past lawsuits.  Lindsay is claiming she never laid a hand on Tiffany and the only contact they had in the club was a confrontation to get her purse back that Lohan thought Mitchell had taken.

Police detectives have confiscated the club’s surveillance tape to hopefully provide evidence to who is really telling the truth about the assault!

Bad news for Lindsay, this assault charge could be a probation violation on a prior case.  It’s the judges discretion to determine the penalty for the probation violation.  She could be fined, face jail time, be assigned to work crew, etc.
