Are You Screwed If You Get Multiple DUIs In 1 Week?

Are you screwed if you get multiple DUIs in 1 week?  Most would think “hell ya” especially when considering the fact that penalties drastically increase with each additional DUI charge.  With two, three, four DUIs in 1 week that would amount to years in jail, thousands of dollars in fines, and loss of a driver’s license for years, right?

“Wrong, that individual may be able to avoid all those penalties by bundling those DUI charges and entering them into a deferred prosecution ,” according to Senior DUI defense attorney, David O.  A deferred prosecution is a program offered by Washington State that allows individuals suffering from; 1. alcoholism or 2. mental illness and substance abuse, to receive professional help and treatment.  To enter into this program an individual must sincerely believe they suffer from alcoholism or mental illness and substance abuse and it must be their first time entering into a deferred prosecution (an individual only gets one deferred prosecution in their life time).  The benefit of entering into a deferred prosecution is the dismissal of the case upon completion of the treatment program and among other requirements, remaining out of legal trouble for five years.  No jail time or additional years driver’s license suspension.  However, if an individual fails to complete the treatment program or receives a new criminal charge within five years, then their deferred prosecution contract is considered broken and they will be sentenced for their original DUI charges by a judge.

It may seem far-fetched that someone would acquire multiple DUI charges in 1 week, but it does happen.  On February 24, 2014 a man in New Jersey was arrested three separate times for drunk driving, all occurring within a seventeen hour time span.  The third arrest occurred when police recognized the 46 year-old man’s licence plates from the two prior DUI arrests earlier in the week.  The man tried to flee from police but came to an abrupt halt when he crashed into a fire hydrant.  The man was arrested and charged with another DUI, eluding law enforcement, and numerous motor vehicle citations.

If the DUI laws in New Jersey are similar to those in Washington this guy would want to hire an experienced DUI lawyer to review his case and help decide if a deferred prosecution would be a good option.  Before agreeing to resolve any criminal matter you should always be well informed of the terms and conditions of the agreement and the terms of noncompliance if it applies.  Entering into a deferred prosecution has it’s benefits but it is not a breeze to successfully complete.

Tito Ortiz Arrested For DUI

Ultimate Fighter Champion mega star Tito Ortiz was busted for a DUI (driving under the influence) yesterday morning.  To make matters worse,  he crashed his 2012 Porsche Panamera into a cement highway median….Ouch poor Tito, injured neck and expensive car repairs!

According to LA law enforcement, Jacob Christopher,  aka Tito Ortiz, was heading home around 4am after celebrating all night at the BCS Football party at the Playboy Mansion.  LA County Sheriffs located Tito and his two passengers on the shoulder of freeway 405 in his wrecked vehicle.  Tito was suspected of drunk driving and was subjected to the DUI field sobriety tests.  The 38-year-old also blew into the portable breathalyzer test which revealed a BAC level of .12.  California State’s legal drinking limit is .08, the same as Washington State’s.

Tito was arrested for DUI and hauled into a local police station.  Tito’s bail was set at $15,000.00 which he posted later that morning.

It doesn’t appear that anyone was seriously hurt during the accident, lucky for Tito.  Unlucky for Tito, ex-wife Jenna Jameson, has recently voiced she is going to use Tito’s recent DUI arrest as leverage to regain custody of their two boys, fearing for the boy’s safety.  Today she said, “A lot of people think he’s this fantastic guy … it’s just not true.”  Jameson is not the most reliable source, she has an extensive history of crazy-erratic behavior.

It is definitely in Tito’s best interest to hire a well qualified DUI defense attorney.  Not only will the DUI lawyer handle his DUI case but the lawyer will also be able to provide sound legal advice for dealing with his ex-wife if issues should arise.

All Jokes Aside, Comedian Kevin Hart Tells the Truth About His DUI

Stand up comedian, Kevin Hart, made no jokes about his DUI and resisting arrest charges back in April, in fact he told the truth during the arrest, admitting he was drunk driving!

Allegedly, Kevin was pulled over by police for racing along LA highways at speeds of 90 mph and almost colliding into a gas tanker.  He was pulled over and arrested for DUI after failing the DUI field sobriety tests, blowing a .15 breath test result (almost twice the legal DUI limit) and outright telling officers he was drunk!….Silly man, he shouldn’t have convicted himself like that, but I guess there is always something to be said about telling the truth.

In an interview, Kevin said he was charged with resisting arrest because he requested to remove his expensive gold watch from his wrist before officers handcuffed him.  Officers felt Kevin wasn’t being compliant and charged him with resisting arrest…..no wonder cops are called bad names, if they were in the same situation I’m sure they wouldn’t want their $$ blingin watch scratched either.

Yesterday, funny man Kevin took responsibility for his first DUI charge and pled no contest.  He was sentenced to 3 months of DUI alcohol education classes and 3 years of probation.
