Ultimate Fighter Nick Diaz Arrested for DUI

Ultimate Fighter Nick Diaz Arrested for DUI

A few weeks ago, Ultimate Fighter mega star Nick Diaz was arrested for DUI in California.  The story becomes much more entertaining when apparently Diaz gets the bright idea to vomit the alcohol out of his system,~ hey he’s probably used the same method to make-weight, he must have thought it would also work for lowing an alcohol BAC level.  Unfortunately for Nick, he was unable to perform, and his creativity only landed him two additional legal charges of obstructing a police DUI investigation and destroying evidence (aka, trying to puke out the booze).

Diaz landed the DUI at 2am on September 6th when he was stopped by CA police officers for committing a traffic violation.  Upon questioning, the officers allegedly could smell odors of alcohol and visually noticed signs of intoxication.  The 31 year-old pro figher was arrested for DUI and was taken into custody.

While at jail, police officers asked Diaz if he wanted to provide a blood sample or breath sample, Diaz chose the breath sample.  While officers set up the breathalyzer machine, Diaz asked to use the restroom, where he tried to eliminate his DUI evidence.  The police could hear the gagging and immediately stopped Diaz before he could “toss any cookies”.  According to watch commander Sergeant Steve Maynard, Diaz’s attempt to vomit was considered a refusal to take the test.  Here in Washington State, refusal of both the breath or blood test will result in even harsher penalties if found guilty of the DUI, than compared to someone who submits to either the breath or blood tests.  Diaz was booked and charged with misdemeanor DUI, driving on a suspended license, obstruction of a police investigation, and destroying evidence.  To make matters worse, this is Diaz’s second DUI within a year.  Last November, Diaz was arrested and charged with DUI and unsafe speed for prevailing conditions.

Recently, sports agent Lloyd Pierson released statements on behalf of Diaz regarding the DUI arrest, “He is very sorry he has disappointed his fans, friends and family.  Nick wants to take the opportunity to thank all his fans who have immediately reached out to him for unconditional support.”

With a much-anticipated fight ahead ~ UFC 183 Nick Diaz VS Anderson Silva ~ January 31, Diaz better get a strong criminal defense attorney to defend his rights and knockout his new legal charges.

Nick Diaz is due back in court on September 25th for his DUI arraignment.

Former Seattle Seahawk Spencer Ware Charged with 2nd DUI this Year.

Former Seattle Seahawk Spencer Ware Charged with 2nd DUI this Year.

Bad news for former Seattle Seahawk running back Spencer Ware… not only was he released by the Seahawks on Saturday but he also got popped with a DUI charge on Tuesday.  Apparently, Ware was arrested for allegedly drunk driving on Tuesday morning in Maple Valley and was booked into the Kent jail at 3:21am.

This is Spencer Ware’s second DUI within this year, his first DUI was on January 9th when he was on the Seahawks injured reserve list.  The 22-year-old was lucky in July, his DUI case was dismissed after a ruling that the arresting officer did not have a lawful basis to initiate the traffic stop.  The judge also suppressed all evidence gathered after the traffic stop, which included incriminating evidence such as the BAC test and DUI field sobriety test results.

Although Ware’s January DUI was dismissed, it will likely be used against him during the resolution of his new DUI charge.  Ware’s next court date is his arraignment set for September 8th in the Maple Valley Municipal Court.

Currently Spencer Ware is a free agent and has yet to be picked up by an NFL team.

On a side note, downtown Seattle is buzzing with fanatical Seahawk fans, regular season opening game day, Seahawks vs. the Green Bay Packers, go Hawks!

NFL Player John Abraham Found Asleep at the Wheel – Charged With DUI

NFL Player John Abraham Found Asleep at the Wheel – Charged With DUI

Around four in the afternoon on June 29th, NFL linebacker John Abraham was charged with DUI after Georgia police officers startled him by waking him up from his midday cat nap.

Allegedly, Abraham had been drinking at the Pink Pony gentlemen’s club and decided to head out around four.  Shortly after, police found the Arizona Cardinal stopped in the middle of the road  sound asleep at the wheel.  Police say they pounded on the windows and doors of the car but it took several minutes for the big defensive player to wake up – police reports described Abraham as 6’4” tall, weighing approximately 225 pounds.

Once he woke up from his afternoon siesta, Abraham told cops he had come from the Pink Pony strip club and that he only had two drinks while there.  The officers immediately suspected 36 year-old of DUI, noting the smell of alcohol on his breath and his inability to communicate clearly, “He appeared confused and rambled while speaking.”

After failing multiple DUI field sobriety tests, John Abraham was arrested and charged with DUI and improper stopping in the roadway.

Abraham is no stranger to being arrested, in fact this was Abraham’s third run in with the law while playing for the NFL.  Back in 2003, he was arrested for DUI after plowing into a fire hydrant and ramming into a light pole.  He plead guilty to the DUI in order to avoid possible jail time.   In 2012, Abraham was charged with two counts of misdemeanor obstruction for failing to exit an area that had been taped off by police.

As of recent, the pro football player has missed the first three days of Cardinal training camp, which some speculate may be related to the June DUI charge.  Spokesmen for the Cardinals say they are aware of the DUI arrest but decline any further comments.

If Abraham is found guilty of the DUI charge he may face jail time, fines, alcohol treatment classes, and suspension of his driver’s license.  Additionally, the NFL will enforce some type of punishment such as fines and/or game suspensions.
