When an individual is found guilty of  a second DUI (driving under the influence) within seven years from the first DUI conviction the penalties become tougher and increase in duration and cost.

Here are Washington States minimum and maximum penalties for a second DUI within seven years.

If the BAC (blood alcohol content) result was less than .15, penalties for a 2nd DUI are as follows:

  • Days in Jail:  30-364 and 60 days of EHM (electric home monitoring)
  • Fines:  $1,196.00 to $5,000.00
  • Ignition Interlock Device:  5 years
  • License Revocation:  2 years.

If the BAC result was more than .15 or a BAC refusal, penalties for a 2nd DUI are as follows:

  • Days in Jail:  45-364 and 90 days of EHM
  • Fines:  $1,621.00 to $5,000.00
  • Ignition Interlock Device:  5 years
  • License Revocation:  900 days if BAC result was more than .15 Or 3 years if BAC was refused.

Calling all boaters, it is illegal to drive a boat while under the influence of alcohol with a BAC level above .08.  Instead of receiving a DUI (driving under the influence) charge, an individual suspected of drunk driving a boat would be charged with a BUI (boating under the influence).

Just last week, Erin Brockovich, who’s dramatic life story was portrayed by actress Julia Roberts, was booked with BUI when a Lake Mead game warden approached her boat to investigate a yelling match occurring between herself and her husband.  Not only did the Nevada game warden hear yelling and screaming, but he watched Erin throw her cell phone into the water and then slap her husband across the face.

The warden suspected possible BUI, noting Erin’s slurred speech and odor of alcohol.  When asked to dock her boat, Erin replied to the warden, “not very good at driving,”  The warden himself assisted Erin and her husband with docking the boat safely.

Erin’s breathalyzer test reveled BAC levels of .186 and .190, twice the legal limit!  Brockovich was arrested and charged with BUI.

In remorse of her drunk driving decisions, Erin released the following statement.  “I apologize for my actions Friday evening. After a day in the sun and with nothing to eat it appears that a couple of drinks had a greater impact than I had realized. It is very important to note that I was not operating the boat in open waters, I was moving it within its own slip. At no time was the boat away from the dock and there was no public safety risk. That being said, I take drunk driving very seriously, this was clearly a big mistake, I know better and I am very sorry.”

In Washington State a BUI charge is a misdemeanor charge.  BUI maximum penalties include 90 days in jail and/or a $1000.00 fine.

Sportscaster, Al Michaels, Charged With DUI

Legendary sports broadcaster, Al Michaels, has been charged with misdemeanor DUI stemming from his DUI arrest in California on April 19th.

Santa Monica officers reported Michaels made a U-turn in front of their DUI sobriety check point around 10PM.  Hmmm, seems like someone knew they had a little too much to drink!  Officers pulled Michaels over and immediately detected an odor of alcohol on his breath.  They continued their DUI investigation and had him perform the DUI field sobriety tests, of which he failed.  Al Michaels was arrested for DUI and taken to jail.

Good news for the voice of “Sunday Night Football”, his DUI breathalyzer test reveled a .08 and .09 blood alcohol level, right at the legal limit.  Additionally, Michaels doesn’t have any criminal history, thus, if Michaels hires a good DUI criminal defense attorney he has good fighting chances of avoiding jail time and getting his DUI charge reduced to a lesser charge.
