Ultimate Fighter Nick Diaz Arrested for DUI

A few weeks ago, Ultimate Fighter mega star Nick Diaz was arrested for DUI in California.  The story becomes much more entertaining when apparently Diaz gets the bright idea to vomit the alcohol out of his system,~ hey he’s probably used the same method to make-weight, he must have thought it would also work for lowing an alcohol BAC level.  Unfortunately for Nick, he was unable to perform, and his creativity only landed him two additional legal charges of obstructing a police DUI investigation and destroying evidence (aka, trying to puke out the booze).

Diaz landed the DUI at 2am on September 6th when he was stopped by CA police officers for committing a traffic violation.  Upon questioning, the officers allegedly could smell odors of alcohol and visually noticed signs of intoxication.  The 31 year-old pro figher was arrested for DUI and was taken into custody.

While at jail, police officers asked Diaz if he wanted to provide a blood sample or breath sample, Diaz chose the breath sample.  While officers set up the breathalyzer machine, Diaz asked to use the restroom, where he tried to eliminate his DUI evidence.  The police could hear the gagging and immediately stopped Diaz before he could “toss any cookies”.  According to watch commander Sergeant Steve Maynard, Diaz’s attempt to vomit was considered a refusal to take the test.  Here in Washington State, refusal of both the breath or blood test will result in even harsher penalties if found guilty of the DUI, than compared to someone who submits to either the breath or blood tests.  Diaz was booked and charged with misdemeanor DUI, driving on a suspended license, obstruction of a police investigation, and destroying evidence.  To make matters worse, this is Diaz’s second DUI within a year.  Last November, Diaz was arrested and charged with DUI and unsafe speed for prevailing conditions.

Recently, sports agent Lloyd Pierson released statements on behalf of Diaz regarding the DUI arrest, “He is very sorry he has disappointed his fans, friends and family.  Nick wants to take the opportunity to thank all his fans who have immediately reached out to him for unconditional support.”

With a much-anticipated fight ahead ~ UFC 183 Nick Diaz VS Anderson Silva ~ January 31, Diaz better get a strong criminal defense attorney to defend his rights and knockout his new legal charges.

Nick Diaz is due back in court on September 25th for his DUI arraignment.

Bad news for former Seattle Seahawk running back Spencer Ware… not only was he released by the Seahawks on Saturday but he also got popped with a DUI charge on Tuesday.  Apparently, Ware was arrested for allegedly drunk driving on Tuesday morning in Maple Valley and was booked into the Kent jail at 3:21am.

This is Spencer Ware’s second DUI within this year, his first DUI was on January 9th when he was on the Seahawks injured reserve list.  The 22-year-old was lucky in July, his DUI case was dismissed after a ruling that the arresting officer did not have a lawful basis to initiate the traffic stop.  The judge also suppressed all evidence gathered after the traffic stop, which included incriminating evidence such as the BAC test and DUI field sobriety test results.

Although Ware’s January DUI was dismissed, it will likely be used against him during the resolution of his new DUI charge.  Ware’s next court date is his arraignment set for September 8th in the Maple Valley Municipal Court.

Currently Spencer Ware is a free agent and has yet to be picked up by an NFL team.

49ers Aldon Smith Plead No Contest to DUI Charges and Now Struck With 9 Game Suspension

The hammer of NFL commissioner Roger Goodell has fallen hard on 49ers linebacker Aldon Smith.  Goodell suspended Smith for nine football games due to his violations of the NFL’s personal conduct policy and substance abuse policy.  Smith will start his suspension this Saturday and will finish on November 10th, the day after the 49ers play the New Orleans Saints.

The heavy suspension came shortly after Smith wrapped up his criminal cases involving DUI, possession of marijuana, and possession of weapons.  Just before the start of training camp, the 24 year-old plead no contest to the DUI and weapons charges and was sentenced to three years of probation and 11 days of work crew.

After his DUI arrest back in September 2013, Smith was suspended indefinitely from the team and sought out help with substance abuse.  He enrolled himself in an in-patient treatment center and has claimed he has remained sober ever since.  When deciding Smith’s punishment, Goodell said he considered Smith’s time in rehab and that it was in his favor.

Niners general manager Trent Baalke supported his star athlete when he released this statement on Friday, “Our organization has known this decision would come and we have prepared for it as a team. Aldon has taken responsibility for his actions and has continued to show growth personally and professionally. We will continue to support him, but it is time to put this matter behind us and focus on the season ahead.”

And yes, they better focus on their season ahead, because the Seahawks are ready to be the World Champs again! Go Hawks!!
