DUI Arraignment Today for Actor John Stamos

DUI Arraignment Today for Actor John Stamos

At some point today, 52-year-old actor, John Stamos will be in front of a Los Angeles Court Judge today for arraignment of his DUI charge.  He is facing one misdemeanor count of DUI which is a result of his June 12th arrest, when he was allegedly driving erratically and behaving strangely.

It appears that drugs were the culprit of Stamos’s DUI and alcohol was not a factor.  Prosecutors are saying that the hospital records revealed drugs in Stamos’s body but they are not sharing what type of drug.

A DUI involving drugs and a DUI involving alcohol are essential the same charge, “Driving Under the Influence” thus the penalties are the same.

If found guilty of this DUI charge, Stamos, aka “Uncle Jesse” on the 1987-1995 sitcom “Full House” could face up to 6 months in county jail.

What is an arraignment and what happens?

An arraignment is the first appearance in court, which is referred to as the “arraignment hearing.” At this hearing the person accused, called the defendant, is formally told of the crime(s) he or she is accused of and is advised of his or her rights. The judge will want to hear the defendant plead guilty or not guilty. ** The DUI and criminal defense attorneys of David O Defense strongly encourage every defendant to plead not guilty at the arraignment hearing.** After the defendant pleads not guilty the court will consider whether or not to take the defendant into custody while the case is pending or consider conditions of release.

Examples of conditions of release could include but are not limited to:

  1. Bail (monetary collateral to the court to guarantee an individual’s presence in court when scheduled).
  2. Law abiding behavior.
  3. No contact with certain persons.
  4. Installation of an ignition interlock.
  5. No driving under certain conditions.
  6. Required electronic home monitoring with alcohol detection devices.
  7. Random urinalysis test.
  8. Released on personal recognizance (simply agree to return back to court as scheduled).

Actor John Stamos enters Rehab after DUI Arrest

Actor John Stamos enters Rehab after DUI Arrest

Last month, “Full House” actor, John Stamos, was arrested in Beverly Hills for DUI, driving under the influence. And now with his career on the brink of taking off again, Stamos has decided to seek help by checking into rehab for substance abuse.

John Stamos, who played Uncle Jesse on “Full House” was allegedly so drunk and wasted that Beverly Hills police sent him straight to the hospital after arresting him for DUI.

Apparently on the night of his June arrest, police responded to multiple calls reporting a silver Mercedes driving dangerously on the roads. Law enforcement caught up with 51-year-old Stamos and pulled him over around 7:45 pm. Upon initial observation police felt Stamos needed immediate medical attention. They cuffed him and called an ambulance to rush him to the local hospital.

Police followed the ambulance to Cedars-Sinai Medical Center where they cited Stamos for misdemeanor DUI while he was getting treatment.

The following morning John Stamos tweeted: “Thanks to everyone for their love & support. I’m home and well. Very appreciative of the BHPD & Cedars for their care.”

Now, about a month later, Stamos has enrolled himself in rehab for substance abuse. A wise decision since he has a lot a stake with Fall TV premiers right around the corner. Stamos once again stars as Uncle Jesse in the new Netflix “Fuller House” a follow-up to original “Full House.” The actor can also be seen on “Grandfathered” a Fox sitcom.

Unfortunately, Stamos lost his co-hosting position for the 2015 Emmy Awards scheduled to air on July 16th. He was replaced by Cat Deeley. It is unknown if the replacement was related to the DUI arrest or not.

Stamos is due back in court on September 11th to continue to address his DUI charge.

Good luck John Stamos, we hope you have a healthy recovery and that you obtain optimal results with your DUI case! – David O Defense

Likely 1st Round NFL Draft Pick, P.J. Williams, Arrested for DUI

Likely 1st Round NFL Draft Pick, P.J. Williams, Arrested for DUI

Last Friday, March 3rd, former Florida State cornerback P.J. Williams was arrested for DUI.  Florida State University Police reports say that Williams was clearly under the influence of alcohol due to his slurred speech and swaying back and forth while standing. Williams, however is denying the DUI allegation, saying he was not drunk that day and that he is planning to fight the case to prove his innocence.

The 21-year old football phenom allegedly was pulled over by Florida State Univ. police around 3 am for making an illegal left turn while exiting a McDonald’s.  Police also say they saw him swerve and almost side swipe a curb.

During the DUI investigation, police say P.J. Williams attempted to play the famous athlete card… don’t you know who I am?  I’m a FSU football player, about to be drafted into the NFL…  Needless to say, it had no effect on police and they still arrested him for DUI and hauled him into jail.

Later that morning, P.J. posted the $500.00 bail and was released.  Since the DUI arrest, P.J. has hired a lawyer to defend his drunk driving charge.  A few days later, on the 7th he officially pled not guilty to the DUI charge.

His lawyer released statements about the DUI arrest saying, “He did have a drink or two earlier,” but he cut himself off hours before getting behind the wheel to because he was the designated driver that night.  “… he was taking everyone to McDonald’s.  “It’s what 21-year olds do.”

P.J.’s defense attorney is optimistic about the DUI case, telling reporters that Williams did not submit to the DUI breathalyzer test or a blood draw so there is no BAC (blood alcohol content) result.  Additionally, the video surveillance taken by the police car dash cam may actually help P.J.’s DUI case.

Williams is adamant he was not DUI and he and his attorney plan to fight the charge to the end, even if that means taking the case to trial.  P.J. is due back to court soon.  The NFL draft pick begins on April 30th, and hopefully P.J.’s DUI arrest won’t hinder his chances of becoming a pro ball player.
